Response to the DDS Emergency Eligibility Regulations

 

DLC has been actively involved in trying to reform the rules for eligibility for adult services from the Department of Developmental Services (DDS).  This work has included supporting legislation (H 4252) designed to change the IQ requirements used, to adopt a more flexible standard, rather than a rigid cutoff IQ score of 70 or below.

 

Most recently, the Appeals Court struck down DDS’s eligibility regulations.   The Department issued new emergency regulations, and DLC testified to urge DDS to adopt a more flexible standard.   Our written testimony (also submitted with MHLAC, MAC and the Arc of Massachusetts) can be viewed here.
